Service Terms & User Agreement

1. Introduction


We are iWriterly or iwriterly.net (the “Platform”). By registering an account or using the Platform, you (“User,” “Client,” or “Freelancer”) agree to comply with these Service Terms and all applicable laws. iWriterly operates as a marketplace connecting Clients with Freelancers and is not a party to any contracts formed between Users.

2. User Eligibility


  • Users must be at least 18 years old or of legal age to enter contracts in their jurisdiction.
  • Users must provide accurate and complete information during registration.
  • Users are responsible for maintaining the confidentiality of their account credentials.

3. iWriterly’s Role


  • iWriterly facilitates connections between Clients and Freelancers, provides tools for contract creation, escrow payment processing, eWallet management, and dispute resolution.
  • iWriterly is not a party to any Service Contract between Users.
  • All obligations, including quality of work, timeliness, and payment approval, remain solely between the Client and the Freelancer.
  • iWriterly may suspend, restrict, or terminate access to the Platform in accordance with these terms, without being liable for disputes between Users.

4. Service Contracts


4.1 Predefined Project Contracts (“Order Now”)


  • Freelancers may list predefined projects with set pricing, scope, and delivery timelines.
  • Clients clicking “Order Now” and completing payment form a binding Service Contract.
  • Milestone Payments: Projects may be split into milestones. Funds for each milestone are held in escrow and released upon Client approval.
  • If no milestones are used, full payment is held in escrow until deliverables are approved or auto-approved after the review period.

4.2 Custom Offer / Bid Contracts


  • Freelancers can submit offers or bids on Client job postings.
  • A binding Service Contract is formed when a Client accepts a Freelancer’s offer.
  • Milestone or Hourly Contracts: Users can define milestones or hourly rates. Hourly work is tracked via iWriterly’s tools, and invoices are generated weekly. Payment is released after Client review.

5. eWallet


  • Each User has an eWallet accessible from their login dashboard. All cleared funds from completed contracts are credited here.
  • Freelancers may withdraw funds from their eWallet subject to the following rules:
    • Funds held for at least 2 weeks: no administrative fee, but a Standard Withdrawal Fee applies to cover payment gateway costs.
    • Funds withdrawn earlier than 2 weeks: a Standard Withdrawal Fee applies, plus an additional 2% to cover administrative costs.
  • Clients may use their eWallet to fund projects or prepay milestones.
  • Available withdrawal methods: Stripe only.

6. Payment & Escrow


  • All payments are processed through iWriterly’s secure escrow system.
  • iWriterly holds funds until the Client approves the work or milestones, or until automated release occurs per the review period.
  • Users authorize iWriterly to act as the escrow agent for all transactions.
  • iWriterly may charge platform fees, service fees, or transaction fees as disclosed in the fee schedule.

7. User Responsibilities


  • Users must deliver work as agreed in the Service Contract.
  • Clients must provide clear project requirements and review deliverables in good faith.
  • Users must not engage in fraudulent, abusive, or illegal behavior.
  • All communication must occur on the Platform until a Service Contract is formed. Sharing external contact details prematurely is prohibited.

8. Ownership & Intellectual Property


  • Unless otherwise agreed, completed work transfers full ownership to the Client upon full payment.
  • Freelancers retain ownership of pre-existing tools, code, or intellectual property incorporated in the work.
  • Users must respect copyrights, trademarks, and intellectual property rights of others.

9. Platform Use & Prohibited Activities


Users may not:


  • Circumvent iWriterly’s platform for payments or contracts.
  • Impersonate another user or entity.
  • Upload harmful, offensive, or illegal content.
  • Engage in spamming, phishing, or malicious activity.
  • Attempt to reverse engineer iWriterly’s platform or tools.

10. Dispute Resolution


  • Users are encouraged to resolve disputes through iWriterly’s internal dispute resolution system.
  • iWriterly may mediate disputes but is not liable for contract performance or quality of work.
  • iWriterly may suspend or terminate accounts involved in repeated disputes or violations of these terms.

11. Termination


  • iWriterly may suspend or terminate accounts for violations of these Service Terms, fraudulent activity, or inactivity.
  • Users may close their accounts at any time, but any pending Service Contracts must be completed or cancelled in accordance with escrow rules.

12. Warranties & Liability


  • Users represent that they have the right and ability to perform work offered on the Platform.
  • iWriterly provides the platform “as-is” and is not responsible for User conduct, quality of work, or project outcomes.
  • Liability is limited to the amount paid for services through the Platform.

13. Disclaimer

  • The Platform and all related services are provided on an “AS IS” and “As Available” basis.
  • iWriterly does not guarantee the accuracy, reliability, or completeness of any content, listings, or user-provided information.
  • iWriterly is not responsible for any losses, damages, or claims arising from the use of the Platform, including but not limited to job or project outcomes, user interactions, or technical issues.
  • Users agree to use the Platform at their own risk and waive any claims against iWriterly except where prohibited by law.

14. Privacy & Data


  • iWriterly collects and processes personal data according to its Privacy Policy.
  • Users consent to communications related to their account, transactions, and Platform updates.
  • Users must not misuse others’ personal data.

15. Governing Law & Jurisdiction


  • These Service Terms are governed by the laws of the jurisdiction in which iWriterly operates.
  • Users agree that disputes may be resolved in the courts or arbitration procedures designated by iWriterly.

16. Modifications


  • iWriterly may update these Service Terms from time to time.
  • Continued use of the Platform constitutes acceptance of any updated terms.

17. Account Termination & Subscription Cancellation


17.1 Deleting Your Account


  • Users may delete their iWriterly account at any time.
  • Once your account is deleted:
    • Your subscription will be cancelled.
    • All data, including login details, profile information, job posts, gigs, transaction records, and other related information, will be permanently removed from iWriterly’s servers.
    • Certain data may be retained as required to comply with our Privacy Policy or legal obligations.
    • Deleting your account will terminate your access to the Platform immediately.

17.2 Freelancer Subscription Cancellation


  • Freelancers with paid subscriptions must provide iWriterly with a 30-day written notice before the intended cancellation date.
  • The date on which you notify iWriterly will be considered your official cancellation date.
  • After cancellation:
    • All existing “Bridges” (or similar features tied to the subscription) will remain on a free account.
    • Any subscription benefits or paid features will cease after the cancellation period ends.

18. Membership Area


  • Your login details are designated for your own use per account. Account sharing is expressly prohibited.
  • You are responsible for maintaining the confidentiality of your login details (username and/or password) and are fully responsible for all activities under your account.
  • You agree to: (i) immediately notify us of any unauthorized use of your login details or any other breach of security, and (ii) ensure that you logout from your account at the end of each session by clicking the “Log Out” button via your dashboard.
  • iWriterly will not be liable for any loss or damage arising from your failure to comply with these terms.

19. Expiry of ‘Beginners’ Plan


  • When you register as a freelancer, you’ll automatically receive a free trial subscription 'Beginners' Plan valid for 3 months from the date of registration.
  • After the trial expires, you can continue using the platform with limited features: you will not be able to send job proposals or place bids.
  • Subscribing to a plan grants access to all features and increases your chances of getting more jobs (also referred to as 

20. KYC (Know Your Customer) Policy

To comply with applicable financial regulations and anti-money laundering (AML) laws, we operate a Know Your Customer (“KYC”) policy. As part of this policy, we may require users to verify their identity before making or receiving any payments.


All onboarding and payment processing are conducted through Stripe, our authorized payment service provider. By using our services, you agree to provide accurate, current, and complete information as requested for KYC verification. Failure to complete or pass KYC verification may result in restricted access to certain features, withdrawal limitations, or suspension of your account.


We reserve the right to update our KYC procedures at any time to ensure ongoing compliance with legal and regulatory obligations.


21. Entire Agreement


These Service Terms, together with the Privacy Policy, Fee Schedule, and other policies published by iWriterly, form the entire agreement between iWriterly and Users regarding Platform use.
